Terms and Conditions

For all bookings

For all booking made through Aberdovey Breaks/CottagesAberdovey/HolidaysAberdovey/any third party Platforms such as Holiday Lettings/Owners Direct/HomeAway/Air BNB and Independent Holidays will be subject to these Terms and Conditions. Please read thoroughly
There maybe also individual property Terms and Conditions also, these will be sent when confirmations are issued

The above are websites owned or properties managed on them via by Independent Holidays Ltd.
Independent Holidays acts only as the Booking Agent for the Owners of the Properties shown on the website/platforms.
When booking a Property you enter into a contract with the Owner of the Property booked subject to the following Terms and Conditions, Independent Holidays do not act as the principal
Independent Holidays are not responsible for Property Owners descriptions however they will do their utmost to keep up to date and amend when advised by individual owners
Bookings will only be accepted on the payment of the agreed deposit. Bookings are not confirmed until Aberdovey Breaks issues your Booking Confirmation via Independent Holidays which is sent via email 

Deposit and Final Payment
A minimum deposit of £50.00 (unless otherwise agreed) is required when confirming and until this deposit is received by the Owners any reservations ares deemed provisional and may be varied or cancelled without prior notice.
The balance is due 6 weeks before the first day of the planned holiday.
If the owners do not receive the balance by the due date, the Owners reserve the right to cancel and resell the period concerned, any monies paid would be forfeited.
If a client makes the booking less than 6 weeks before the start of the planned holiday the full payment must be made and until it is paid no Booking Confirmation will be issued.
Payments may be made by cheque, bank transfer, debit/credit card  

Cancellations by the client
If a client wishes to cancel the accommodation booked then the following charges would apply
Booking cancelled over 6 weeks before arrival - loss of agreed deposit
Booking cancelled within 6 weeks before arrival - full cancellation charges apply - all monies paid would be forfeited
We recommend all Clients when booking a property to take out cancellation/Holiday Insurance.
Under no circumstances is it possible to refund holidays, the above terms and conditions would apply.
if you wish to transfer from one property to another property then the normal booking conditions would apply as individual properties are owned by different owners, we would of course do our best to accommodate your requests and offer advice of how to alleviate any extra costs incurred

Cancellations by the Owner
In the unlikely event that the Owner has to cancel the accommodation booked you would be entitled to a Refund of all monies paid
The Agent would give you an opportunity to rent an alternative property and do their very best to arrange however any difference in the holiday cost, the Owner or the Agent would not be responsible, Compensation would not be payable at any time

Curtailment of your Holiday
If you are in breach of the above terms and conditions and your holiday is curtailed the the Agent or Owner no compensation will be paid in any event
If you have a problem with/at the accommodation you must give the agent/owner an opportunity to put right or to offer an alternative accommodation which maybe at your own cost depending on the problem, curtailing your holiday without notice or failure to give the opportunity will mean that no compensation/refunds would be paid.

Your Holiday Booking
The Property Owner allows the person and only the number of persons booked to occupy the Property and only for the dates booked, it allows the persons booked to use the property and contents .
If bringing a large party for celebrations ie hen/stag party please check with one of our advisors.
You or any of your party members must not use the Property except for the purpose of a holiday during the Holiday Period,
If you or any member of your party fails to vacate after the Holiday Period, the Owner shall be entitled, apart from other remedies to charge you a fee proportionate to the Holiday Rental for the continued period of occupation.
The owner or ourselves(the Agent) reserve the right to ask guests who contravene these Terms and Conditions or, who in any other way are behaving in a manner likely to cause distress or nuisance to  other Guests or properties to leave the accommodation immediately.
In these circumstances, the holiday ceases immediately and there will not be any refund considered or any compensation offered for the Hire Period being terminated prematurely

PETS and rules
Each Property will advise if pets (number of pets) are permitted/not permitted in the Property.
If pets are not permitted then under no circumstances should a pet be taken or the number of pets be exceeded.
There maybe a Pet Charge, this will be advised in the property description  
Pets must not be left unattended in any Property
Pets ARE NOT allowed in bedrooms/on any furniture at the property and MUST Be kept under control at all times
Owners must be responsible and clear up any fouling at the property interior or exterior
Pet Owners are  responsible for removing as much pet hair as possible from the Property before your departure, if this is not adhered to and additional cleaning is required the owner reserves  the right to demand extra cleaning charges from the person who made the booking

We do not guarantee that a property that advertises itself as NOT accepting pets that it has not had pets stay there in the past
Bringing a pet without notifying the Agent when booking will mean a charge of £100 will be incurred  
If bringing a pet to a property which does NOT accept pets then you may be asked to vacate the property immediately and pay an extra cleaning charge of £100, there would not be any compensation due for the curtailment of the rental.

Access
Full information regarding access is provided to you once the balance has been paid, this will normally sent via email to the email address provided at the time of booking. Please take this with you on holiday as it is an important part of your documentation

Property Rules
If a property has individual rules this will be sent with the access information

When you rent a property you must allow at all times
The Owner/Independent Holidays or its Agents ie cleaners/maintenance/repair persons access  to visit and check on condition and to make any necessary repairs or  maintenance by appointment or if in an emergency instant access.
The Owner expects the person who made the booking and its party to make sure that the Property/Contents/ furnishings to be kept in clean and in good condition, to report any damage to the property, any breakages and to leave the property in a clean and proper state
The owner expects all persons to adhere to any individual instructions for each property
The owner expects that persons will not cause a nuisance to neighbours or cause any problems which may invalidate any insurance premiums,
if this is not adhered to the owner can enter immediately, repossess the property and charge any damage caused
The owner expects all personal waste and recycling to be removed from the property as per instructions. The owner reserves the right to withhold any security deposits paid if they are not satisfied with how the property has been left after your rental
Every effort is made to ensure all items of equipment described and supplied by Owners are in good working order, however, no guarantee is given or liability accepted if breakdowns occur before or during a holiday. Whilst the Agency and/or Owner will endeavour to organise repairs or replacements as quickly as possible, delays inevitably
do occur, particularly during the main season.

SECURITY/BREAKAGE DEPOSITS
If a security deposit is requested this must be payable at the balance time
Any security deposit will be held by the Independent Holidays on behalf of the owner to cover any damage/losses incurred or additional cleaning charges, this charge will be charged if the property is left in an unsatisfactory condition
After your rental and (subject to inspection) of the property the security deposit will normally refunded to you with 14 days of your return home, any charges you would be notified in advance of the 14 days after your departure

Owners Descriptions
Independent Holidays ensures every effort  that advertised descriptions/photographs shown are correct, Independent Holidays do not own any of the properties featured and therefore rely on any changes made by the property owner(s) that they are notified immediately
If there are amendments to properties we will notify all clients immediately we are aware
If a property has changed its description and we have not been notified Independent Holidays will not be held responsible. Any compensation claimed will not be the responsibility of Independent Holidays equally Independent Holidays has no liability for any incorrect information/mistakes and any claims for costs or additional expense will not be considered

COMPLAINTS
If there is a problem at the property you should initially contact the the persons shown on your Accommodation Voucher or their representative / caretaker for the Property immediately.
If they are unable to help, you should contact the Agent. The Agent will do all it can to rectify the problem, if it is unable to do this and in its opinion the complaint is justifiable, the Agent will  
try to find a suitable solution. Any disputes arising out of the Booking will be between the Customer and the Property Owner. The Agent shall not be liable for any claims by the Customeror the Property Owner.
The Agent or the Owner regrets that it is not possible to consider complaints once a property has been vacated if they have not been reported and verified during the holiday period.
Neither the Owner nor the Agency accepts responsibility for work taking place outside the boundary of a Property, nor for noise or nuisance resulting from third party activity over which the Owner or the Agency has no control or prior knowledge.

Older Properties
Please take into consideration that older properties can be quirky, creaky have uneven floors and walls, steps maybe steep. Please read the property descriptions, these properties may not be suitable for young children or persons of limited mobility
Properties at times can have insects and spiders which will weave a web extremely quickly, although the property has just been serviced you may find cobwebs,
during the summer you may also find beetles,ants. or other insects Many of the stone cottages were built before modern damp courses and in our local climate you may find dampish areas during and after wet spells.

PROPERTY UNAVAILABLE BEFORE HOLIDAY PERIOD
Force Majeure, the Owner and the Company shall not be liable or accountable for any unforeseen circumstances such as severe weather conditions, local or national strikes, fire, floods, acts of government or of any other authorities. In the event that a Property becomes unavailable for reasons beyond the control of the Agency, the Agency will make every effort to offer alternative accommodation and/or holiday dates to the client but if this isn't accepted we advise clients to contact their holiday insurance company to process a claim. You will have no other claim against the Owner or the Agency.

Other Conditions and Important Information

DISABILITIES
The Agency recognise their responsibility under the Disability Discrimination Act 1995 not to discriminate against disabled people in any way and to encourage owners to take reasonable steps to improve accessibility to Properties offered for holidays.
It is the renters responsibility to check the descriptions offered on the website or to check with the agent if they have any queries about suitability of properties.

It is your responsibility to state on any correspondence/booking form/ any disability applicable to any members of your party.
If the Agency considers that a Property may be unsuitable for a disabled person, they will advise you before the booking is confirmed.
As per above the Renter must inform the Agent of any special requirements at the time of booking especially if a party member has any medical condition or disability that may affect the holiday, the Agent must be notified before confirming and paying a deposit for the holiday.
If the Agent feels the accommodation is unsuitable for you or your party's needs the Agent reserves the right not to accept the booking.
If the Renter advises any requirements after the booking is confirmed and the property is then subsequently cancelled then the normal cancellation policy will apply Subject to accommodation being suitable, any registered assistance dogs are accepted free of charge in properties where dogs are allowed and charges applicable.

With regards to any allergies these must be notified at the time of booking, the Owner or the Agency cannot guarantee that the Property booked by you will be free from substances which may cause an allergic reaction and do not guarantee that a pet in general but moreso dogs or cats have not stayed in the Property prior.

The Owner or the Agent will be liable for any symptoms/illness the renter or any party member suffers as a result of an allergic reaction.


LIABILITY
Neither the Owner nor the Agenct will be liable for any death or personal injury unless this results from an act neglect or breach of statutory duty by the Owner or the Agency or any of their employees (providing they were at the time acting in the course of their employment).
You must take all necessary steps to safeguard your personal property. No liability is accepted by the Owner or the Agency in respect of damage to, or loss of, such personal property except where the damage or loss is caused by any act neglect or breach of statutory duty by the Owner or the Agency or that of any of their employees (providing they were at the time acting in the course of their employment).

As the Agency acts only as agent for the Owner, the Agency cannot accept any liability for any act neglect or breach of statutory duty by the Owner or anyone representing, or employed by, the Owner.

Limitation Of Liability. Except in respect of death or personal injury, if the Owner or the Agency is found liable to you on any basis, the maximum amount the Owner or the Agency will have to pay you is the amount of the Holiday Rental.
Neither the Owner nor the Agency shall be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of the Owner or the Agency, their servants or agents or otherwise) which arise out of or in connection with these Conditions.

Every effort is made to ensure all items of equipment described and supplied by Owners are in good working order; however, no guarantee is given or liability accepted if breakdowns occur before or during a holiday. Whilst the Agency and/or Owner will endeavour to organise repairs or replacements as quickly as possible, delays inevitably do occur,
particularly during the main season.

Nothing in these Conditions affects any liability for death or personal injury caused by the Owner's or the Agency's negligence or for fraudulent misrepresentation or your statutory rights as a consumer

FORCE MAJEURE.
No liability can be accepted and no compensation will be paid by the Agent or the Property Owner, where you or your personal property (and/or any person in your party and/or their personal property) suffer any loss, damage, injury, disappointment, inconvenience or otherwise, or where the performance or prompt performance of any obligations by the Agent or the Property Owner are prevented or affected, by any event which the Agent or the

Property Owner
could not have reasonably foreseen or avoided including war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions closure of international borders, disease, none availability of transport services, interruption to services/utilities and all similar events outside the control of the Agent or the Property Owner.

Terms and Conditions Definitions:
The Owner/s' means the Property Owner, The Property' is the Owner's property as per the description on its websites/platforms
'You' means the person/renter booking the accommodation after reading these Terms and Conditions;
The Arrival date' means the date of the commencement of your Holiday Period as per your confirmation
The departure date' is when you depart the property as per your confirmation
Your Booking means renting a property for the dates booked and confirmed and from 4.00 pm on your arrival date  until 10.00am on the agreed departure date unless otherwise agreed;
The Rental Cost ' means the total cost  due and excluding any Security Deposit/Booking Fees/Any Extras ie Bed Linen/Towel Hire

THE AGREEMENT
Any booking made via our website or via an advisor is purely for the purpose of a holiday and in no way creates any relationship of a landlord and tenant. You shall not be entitled to a tenancy, to an assured short hold, an assured tenancy or to any statutory protection under the Housing Act 1988 or to any other statutory security of tenure now or when the Holiday Period ends.
When making a booking via our online booking system or verbally with an advisor you will receive a confirmation/receipt within 24 hours via email to the email address provided This does not form a contract. If there is a issue with the accommodation/dates booked you will be notified within 24 hours, after this time  the contract will be confirmed
 
These Conditions shall be governed by and construed in accordance with UK Law and the parties submit to the exclusive jurisdiction of the UK courts

Damage caused to the Accommodation you have booked and happened during your stay:

AB 1. The person who books the holiday (lead name on the booking made) is responsible for all guests staying at the accommodation and the things they do (and do not do) even if you do not stay at the accommodation during the booking period.

AB.2. The person who books the holiday(lead name on the booking made) is responsible for and agrees to reimburse to the Owner and ourselves all costs incurred by the Owner and/ourselves as a result of any breakage or damage in or to the accommodation which is caused by you or any members of your party or any other persons invited into the accommodation by you during your stay. The Owner and/ourselves can ask for an extra payment from you to cover any such costs. This is applicable to all accommodations shown on our website www.AberdoveyBreaks.com and any third party websites ie AIRBNB or similar where we market the accommodations and where a breakage/Damage deposit has not been requested.

Any damage not reported by you and subsequently reported to us by Housekeeping or the following guest you would be advised within 14 days of your check out date, a further 14 days would then be allowed to pay the cost to repair or replace items damaged or beyond repair. items like a broken glass, plate would not be charged for although the owner and ourselves expect them to be reported so that replacements can be made for following guests

AB.3. The Owner expects the accommodation to be left in a reasonably clean and tidy state on departure. If, in the Owner’s or the Owner's representative’s opinion, additional cleaning is required, you will be liable to the Owner/Ourselves for the cost of this cleaning and would be notified immediately Housekeeping visit the property to clean after your stay and preparing for new guests.

AB 4. You may need to check and sign an inventory of the accommodation and its contents on arrival at the accommodation. In any case If you discover that anything is missing or damaged on arrival please notify the Owner, their representative or ourselves immediately as if not reported the claim for damage etc would be made against the person who books the holiday (lead name on the booking made).

With regards to any allergies these must be notified at the time of booking, the Owner or the Agency cannot guarantee that the Property booked by you will be free from substances which may cause an allergic reaction and do not guarantee that a pet in general but moreso dogs or cats have not stayed in the Property prior.

The Owner or the Agent will be liable for any symptoms/illness the renter or any party member suffers as a result of an allergic reaction.

LIABILITY

Neither the Owner nor the Agenct will be liable for any death or personal injury unless this results from an act neglect or breach of statutory duty by the Owner or the Agency or any of their employees (providing they were at the time acting in the course of their employment).

You must take all necessary steps to safeguard your personal property. No liability is accepted by the Owner or the Agency in respect of damage to, or loss of, such personal property except where the damage or loss is caused by any act neglect or breach of statutory duty by the Owner or the Agency or that of any of their employees (providing they were at the time acting in the course of their employment).

As the Agency acts only as agent for the Owner, the Agency cannot accept any liability for any act neglect or breach of statutory duty by the Owner or anyone representing, or employed by, the Owner.

Limitation Of Liability. Except in respect of death or personal injury, if the Owner or the Agency is found liable to you on any basis, the maximum amount the Owner or the Agency will have to pay you is the amount of the Holiday Rental.

Neither the Owner nor the Agency shall be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of the Owner or the Agency, their servants or agents or otherwise) which arise out of or in connection with these Conditions.

Every effort is made to ensure all items of equipment described and supplied by Owners are in good working order; however, no guarantee is given or liability accepted if breakdowns occur before or during a holiday. Whilst the Agency and/or Owner will endeavour to organise repairs or replacements as quickly as possible, delays inevitably do occur,

particularly during the main season.

Nothing in these Conditions affects any liability for death or personal injury caused by the Owner's or the Agency's negligence or for fraudulent misrepresentation or your statutory rights as a consumer

FORCE MAJEURE

No liability can be accepted and no compensation will be paid by the Agent or the Property Owner, where you or your personal property (and/or any person in your party and/or their personal property) suffer any loss, damage, injury, disappointment, inconvenience or otherwise, or where the performance or prompt performance of any obligations by the Agent or the Property Owner are prevented or affected, by any event which the Agent or the

Property Owner

could not have reasonably foreseen or avoided including war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions closure of international borders, disease, none availability of transport services, interruption to services/utilities and all similar events outside the control of the Agent or the Property Owner.

Terms and Conditions Definitions:

The Owner/s' means the Property Owner, The Property' is the Owner's property as per the description on its websites/platforms

'You' means the person/renter booking the accommodation after reading these Terms and Conditions;

The Arrival date' means the date of the commencement of your Holiday Period as per your confirmation

The departure date' is when you depart the property as per your confirmation

Your Booking means renting a property for the dates booked and confirmed and from 4.00 pm on your arrival date  until 10.00am on the agreed departure date unless otherwise agreed;

The Rental Cost ' means the total cost  due and excluding any Security Deposit/Booking Fees/Any Extras ie Bed Linen/Towel Hire

THE AGREEMENT

Any booking made via our website or via an advisor is purely for the purpose of a holiday and in no way creates any relationship of a landlord and tenant. You shall not be entitled to a tenancy, to an assured short hold, an assured tenancy or to any statutory protection under the Housing Act 1988 or to any other statutory security of tenure now or when the Holiday Period ends.

When making a booking via our online booking system or verbally with an advisor you will receive a confirmation/receipt within 24 hours via email to the email address provided This does not form a contract. If there is a issue with the accommodation/dates booked you will be notified within 24 hours, after this time  the contract will be confirmed

These Conditions shall be governed by and construed in accordance with UK Law and the parties submit to the exclusive jurisdiction of the UK courts

For Competitions

1. All of our various types of competitions are open to registered users of Facebook, aged 18 or over.
The cottage giveaway competition will be available for entries from 8 am on 16th March 2024 to 7 pm on 13th April 2024.
1a. We will have other competitions available which will have various prizes ie: Win a Hamper, Champagne, Meals, etc, and will vary from month to month, please view our Facebook posts for further details.
2. All information detailing how to enter this competition forms part of these terms and conditions. It is a condition of entry that all terms and conditions are adhered to. Submission of an entry will be taken to mean acceptance of these terms and conditions.

4. To enter the competitions, entrants must Like or Follow Aberdovey Break's Facebook page and comment on any one of the Competition Posts that are posted throughout the competition period on the Aberdovey Breaks Facebook Page.
5. Any number of comments may be submitted.
6. Entrants using multiple Facebook accounts will be disqualified and Entries must comply with the terms and conditions of Facebook.
7. Each entrant agrees that they have independently developed and/or have the relevant authority/consent(s) to submit the Entry and will not infringe the intellectual property or any other rights of any person.
8. Entries will not be accepted if deemed inappropriate or offensive, Aberdovey Breaks will use its absolute discretion to make sure rules are complied with.
9. There will be one main Competition winner but if there is more than one prize offered these will be announced separately. No correspondence will be entered into regarding the selection of the winning Entries. The prize is as follows: The winner will receive a 3-night stay at Delfryn Cottage in Aberdovey from Friday 4th October to Monday 7th October 2024 The prize is for up to 6 guests in 3 bedrooms. The total value of the prize is £330.00.
10. Aberdovey Breaks will announce the winner via a Facebook post at 7 pm on the 13th April after the competition has closed. The winner will be notified via a private message and also via a reply to their winning comment. The winner will be drawn at random by a member of the Independent Holidays. In the event of two people with the same name coming forward to claim the prize, the prize will be given to the person whose comment has been responded to by a member of the  Aberdovey Breaks team which says that they are the winner and who has also received a private message.
11. The winners must provide their name, address, email address, and contact telephone number and confirm that they are available to accept the prize as specified by Aberdovey Breaks and the terms of the property as per the property description.
Aberdovey Breaks reserves the right to request proof of age, residence, and identity of the winner, and if the winner suits the bedroom configuration and property owner's booking requirements. If a winner cannot provide any of the above details and confirmations to  Aberdovey Breaks satisfaction within 7 days of being contacted by Independent Holidays and/or cannot confirm they accept the prize within 7 days of being notified by Aberdovey Breaks, the winner’s entry will be deemed invalid and Independent Holidays reserves the right to select another winner from the remaining Entries.
12. By entering, Entrants understand that they are providing their information to Aberdovey Breaks and not to Facebook. This competition is not sponsored, endorsed or administered by, or associated with Facebook. Any questions, comments, or complaints regarding the promotion will be directed to Aberdovey Breaks not Facebook.
13. The winner consents to Aberdovey Breaks announcing their name publicly on their Facebook page as a prize winner, making copies of or publishing the whole or any part of the Entry and otherwise exploiting the Entry and any rights in relation to the Entry for any purpose and without compensation.
14. The information entrants provide will be used only by Aberdovey Breaks for the purpose of conducting this competition.  Aberdovey Breaks may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants, but the information will not be passed on to any other 3rd parties.
15. Aberdovey Breaks reserves the right to amend these terms and conditions at any time or offer a reasonable equivalent to the prize described. The winner may not exchange the prize for cash, or cash alternatives, and is not transferable to other persons or alternative dates.
16. Employees of Independent Holidays/Aberdovey Breaks and its affiliates and any other persons or employees of companies associated with this Competition and members of the families and households of any such persons, are not eligible to enter this Competition. Any such entries will be invalid.
17. In accepting the prize, the prize winner accepts all of Aberdovey Breaks terms and conditions as if booking holiday accommodation through ourselves.
